OBRAINSA was an important company within the construction sector until it was seriously affected financially and reputionally by its relationship with the notorious ODEBRECHT case in Peru.
When a preventive bankruptcy process was filed before the corresponding authority (INDECOPI), our firm represented the creditor TDM Asfaltos S.A.C., which had credits at that moment, as a consequence of the failure in the payment of debt derived from leases of heavy machinery on the part of OBRAINSA, essential assets for the debtor for the development of the projects and the economic activity that carried out.
The representation of our client included the relevant firm’s team individuals in the Creditors Meetings until the Global Refinancing Agreement (AGR) was reached, and a payment schedule was established in favor of the creditors. Currently, the company is being supervised on the compliance of the first payment. However, if the debtor failed in such obligation, the firm shall proceed to request the authority, the inclusion of the company in a bankruptcy proceeding.
