OBRAINSA is a company that focuses its activities on the design, construction, conservation and rehabilitation of road works, and whose principal client was the Peruvian government through the entity “PROVIAS” and regional offices. However, the reputation and finances of this company were seriously affected by the ODEBRECHT case in Peru.
Under such scenario, the referred Company was subject to a preventive bankruptcy process, where our client TDM Construcción S.A. had siginificant current credits -at that moment-, as a result of leases of heavy machinery, assets that were of utter importance for the performance of the core business activities of the debtor OBRAINSA.
Our firm actively participated in the Creditors Meetings until reaching the Global Refinancing Agreement (AGR) , where a payment schedule was approved. Under this light, the company is being supervised on the compliance of the first payment of the schedule. Failure to comply with such obligation will put the company under an event to proceed to the request of its inclusion in a bankruptcy proceeding.
