Our IP practice area provides legal services to Clorox in connection with the registration and protection of its trademark portfolio in Peru. Additionally, our advice includes Intellectual Property litigation before The Peruvian Trademark Office. Our firm also provides legal advice to Clorox regarding an unfair competition action against its main competitor; where our client’s product was denigrated through advertising and consumers were misled about the characteristic and trademark in the Peruvian market. It should be noted that we work closely with our criminal and civil litigation teams to develop joint strategies on violations committed against the portfolio of Clorox Company’s protected brands. Our constant monitoring of Clorox’s trademark portfolio, as well as of any act that could affect the value of the trademarks, has allowed us to position ourselves as the company’s lead attorneys in Intellectual Property matters at the national level.
Also we are advising Clorox in the opposition to Mr. Dilmer Perez Villalobos request for GLOROX trademark registration with a similar label as the one used by Clorox, because the case is transcendental for Clorox, we presented opposition to the registration, using all the arguments that supported the defense of the CLOROX trademark, the Commission of Distinctive Signs declares the opposition founded and ruled in favor of our client, but the applicant has appealed, we are waiting for the transfer of the opposition.
It should be mentioned that Mr. Dilmer Perez has been criminally prosecuted for adulterating the Clorox product on the market.
