Our client is a company founded in January 1965, with contributions from local shareholders and Japanese companies Mitsui & Company LTD. and Toyota Motor Corporation. It has been the official distributor of the Toyota brand in Peru since its beginnings.
In the month of January 2021, a vehicle accident occurred, which was caused by the excessive speed with which Mr. Manuel Pinedo Tapia drove his Toyota vehicle. Far from assuming his civil and criminal responsibility, Mr. Pinedo intends to impute responsibility to our client alleging that the seriousness of the accident was due to the non-activation of the air bags of his Toyota brand vehicle. Along these lines, our client has entrusted us with his defense in the judicial compensation process initiated by Mr. Pinedo. Beyond the large sum that is in dispute, this process is important because if the Judiciary supports Mr. Pinedo’s claim, it would generate a negative incentive for all drivers to evade their responsibility, under the excuse of technical failures in their vehicles.
