Legal advice to the UNIVERSIDAD DEL PACIFICO in the framework of the procedure followed before the Court of Transparency and Access to Public Information as a consequence of the request filed for the University to comply with the delivery of private information to the applicant.
The complexity of the case focused on the analysis of the obligations of private entities to provide information that, in accordance with the Law of Transparency and Access to Public Information, may be considered as public information because it is related to the characteristics of the public service provided. In this sense, the counsel sought to support that not all kinds of information held by private entities can be subsumed in the above-described assumption, and that such rule must be interpreted in a restrictive manner since it is one that establishes exceptions. This case is still ongoing.
